| Middletown Rezoning and Major Plan Approval Process |
| 1. Applicant notifies Town of Middletown of intent to request rezoning approval. |
2. Applicant submits plan to State of Delaware for PLUS review and comment. |
| 3. Applicant submits Rezoning Plan to Town of Middletown Planning and Zoning Commission and Town of Middletown Engineering Consultant for review. |
4. Town of Middletown Planning and Zoning Commission will conduct a public meeting with applicant to review rezoning plan and suggest changes. Planning and Zoning Commission makes recommendation to Mayor and Council to approve or deny the Rezoning Plan. |
5. Applicant submits Rezoning Plan to Mayor and Council for review. Mayor and Council introduce an ordinance to
rezone the property as requested. |
6. Upon one month of review, Mayor and Council will conduct a public meeting with applicant to review and approve or deny the Rezoning Plan. |
7. Upon approval of the Rezoning Plan from the Town of Middletown, applicant submits plan to New Castle County
Recorder of Deeds for recordation. |
8. Town of Middletown revises Zoning Map to reflect the properties new zoning classification. |

| 1. Applicant Submits Conceptual Plan to Mayor and Council for review. |

| 3. Applicant submits Preliminary Plan to Town of Middletown Planning and Zoning Commission, Delaware State Fire Marshal, Public Safety, and Town of Middletown Engineering Consultant for review. Applicant submits Traffic Impact Study to DelDOT for review. |
4. Town of Middletown Planning and Zoning Commission will conduct a public meeting with applicant to review plan and suggest changes. Planning and Zoning Commission makes recommendation to Mayor and Council to approve or deny the PreliminaryPlan. |
| 5. Applicant submits Preliminary Plan to Mayor and Council for review. Mayor and Council will conduct a public meeting with applicant to review and approve or deny the Preliminary Plan. |
6. Upon approval of Preliminary Plan, applicant submits Record Plan to Mayor and Council and Town of Middletown Engineering Consultant for review. |
| 7. Mayor and Council will conduct a public meeting with applicant to review and approve or deny the Record Plan. |
8. Upon approval of Record Plan from the Town of Middletown, Fire Marshal, Public Safety and DelDOT, and receipt of approved Traffic Impact Study, applicant submits plan to New Castle County Recorder of Deeds for recordation. |
| 9. Applicant submits Construction Improvement Plan to Town of Middletown and Town of Middletown Engineering Consultant for review. |
10. Applicant submits revised Construction Improvement Plan to Town of Middletown and Town of Middletown Engineering Consultant form final review and approval. |
| 11. Upon approval of Construction Improvement Plan, applicant submits to the Town of Middletown the appropriate construction bond and inspection fees. |
12. Upon receipt of construction bond and inspection fees, the Town of Middletown conducts a preconstruction meeting with applicant, applicant’s contractor and local utility companies. |
| 13. Applicant receives Notice to Proceed with the approved site improvements. |
14. Applicant submits application to DelDOT for approval, bonding and construction of entrance. |
| 15. Applicant submits architectural plans to the Town of Middletown and Fire Marshal for review and approval of planned buildings. |
16. Upon approval of architectural plans by the Town of Middletown and Fire Marshal, applicant applies for building permit with the Town of Middletown. |
| 17. Applicant begins construction of proposed buildings upon approval of building permit. |
18. Applicant begins construction of entrance upon DelDOT approval of entrance application. |
19. Upon completion of building, applicant schedules final inspection with the Town of Middletown and Fire
Marshal for Certificate of Occupancy. |
20. Upon receipt of final approval from the Town of Middletown and Fire Marshal, and completion of the
entrance to DelDOT’s satisfaction, applicant obtains Certificate of Occupancy. |
